Terms of service

By creating an account or using BYOptimise you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind that company.

BYOptimise connects to marketing data sources you authorise, normalises that data, runs statistical models over it, and presents the results as reports and recommendations.

The output is analysis, not advice. Recommendations are statistical estimates carrying genuine uncertainty, which we show as credible intervals. You remain responsible for your budget decisions and their outcomes. We do not guarantee any particular commercial result.

Keep your login credentials secure and tell us promptly if you believe your account has been accessed by someone else. You are responsible for activity under your account.

You must not attempt to access another customer’s workspace, probe or disrupt the service, or use it to break the law or the terms of the platforms you connect.

You keep ownership of the data you connect and everything derived from it for your workspace. You grant us only the permission needed to operate the service for you: storing, processing and displaying that data back to you.

You confirm you have the right to connect the data sources you link, and that doing so does not breach your agreements with those platforms.

Pricing is a single flat plan with three cadences, shown on the pricing page. All prices exclude VAT, which is added where applicable.

Subscriptions renew automatically until cancelled. You can cancel at any time and will keep access until the end of the period you have paid for. We do not provide pro-rata refunds for partial periods unless the law requires it or we have failed to provide the service.

If we change pricing we will give at least 30 days’ notice before it affects your renewal.

We work to keep the service available but do not currently offer a contractual uptime guarantee. Modelling runs are scheduled weekly and may occasionally be delayed by upstream data or infrastructure issues; where a run fails we will not present results from it.

We may change or remove features, and will give reasonable notice of material removals.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability to you in any twelve-month period is limited to the fees you paid us in that period. We are not liable for lost profits, lost revenue or indirect losses arising from decisions taken using the service’s output.

You may close your account at any time. We may suspend or close an account that breaches these terms, or where required by law, and will tell you why unless legally prevented.

On closure you can export your data. After 30 days we delete it, other than records we must keep for legal or accounting reasons.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
